The Delhi High Court on Tuesday (October 6, 2026) sought actor Salman Khan’s response to a plea by the makers of Kala Hiran: The Battle for Legacy seeking to stay proceedings in the actor’s suit against the film’s proposed release.
Justice Anup Jairam Bhambhani issued notice to Mr. Khan on the application, in which producer Amit Jani argued that the dispute over the film is already the subject of an earlier suit filed by the actor before the High Court.
Mr. Khan has sought to restrain the release of the film, which he claims is based on him. The producer, however, contended that the fresh proceedings amount to parallel litigation over the same film, its promotional material and the alleged infringement of Mr. Khan’s personality and publicity rights.
According to the application, Mr. Khan had earlier filed a suit seeking protection of his personality rights. The High Court granted him an interim order on December 11, 2025. He later sought a separate interim order to stop the release of the film, which is still pending.
Overlapping petition
The producer argued that the relief sought by Mr. Khan in the subsequent application seeking to restrain the release, exhibition, and dissemination of the film and its teasers substantially overlaps with the relief claimed in the earlier proceedings.
The dispute over the film had reached the High Court earlier this year after Mr. Khan objected to its promotional material. On July 27, a coordinate bench directed the removal of a teaser and other related posts from online platforms.
The filmmakers subsequently told the court that the movie was not ready for release as it had not yet been certified by the censor board and its trailer had also not been released.
While passing the interim order, the High Court had restrained the makers of Kala Hiran from exploiting the actor’s name, mannerisms and other distinctive attributes for commercial gain without his authorisation, or disseminating content that could harm his reputation.
The filmmakers, meanwhile, maintain that Kala Hiran is not a biopic of Mr. Khan and argued that the actor cannot use personality rights as a means to “erase” public events surrounding the blackbuck poaching controversy.
